P 05 - Smoke-Free and Vaping Policy

1. Purpose

1.1 This policy has been developed to protect all employees, contractors, clients, and visitors from exposure to second-hand smoke and vapour, and to ensure compliance with the Health Act 2006 and other relevant legislation.

1.2 Exposure to second-hand smoke significantly increases the risk of lung cancer, heart disease, and other serious health conditions. Ventilation or separating smokers and non-smokers within the same airspace does not eliminate this risk.

2. Policy Statement

2.1 The Company is committed to maintaining a smoke-free working environment. All personnel have the right to work in conditions free from the health risks associated with smoking and vaping.

2.2 Smoking and the use of e-cigarettes (vaping) are strictly prohibited in all enclosed or substantially enclosed areas of the workplace, including but not limited to:

  • Offices and meeting rooms
  • Welfare facilities
  • Store containers
  • Company vehicles
  • Enclosed areas under construction that become enclosed

 

2.3 This policy applies to all employees, consultants, contractors, clients, customers, and visitors.

2.4 Smoking or vaping is only permitted in designated outdoor smoking areas. It is not allowed near entrances, exits, or open windows of any Company building.

3. Implementation

3.1 Overall responsibility for implementation and review of this policy rests with the Directors and Management. However, every individual is expected to comply with and support its enforcement.

3.2 All personnel, consultants, and contractors will be informed of this policy and their obligations.

3.3 All new starters will be briefed in induction of this policy. 

3.4 “No Smoking or Vaping” signage will be clearly displayed at entrances and within all smoke-free areas.

3.5 Head Office & Plant Yard

Designated smoking areas are provided outside the main building. This arrangement will continue only if cigarette butts and vaping materials are disposed of responsibly using the containers provided. Failure to do so may result in smoking and vaping being banned entirely within the grounds.

3.6 Construction Sites

Personnel must check site-specific rules for additional restrictions. Some sites may enforce a total ban or only allow smoking/vaping in clearly identified designated areas.

3.7 Visitors and Subcontractors

Managers and supervisors must ensure that all visitors, clients, and subcontractors are made aware of this policy and comply with local rules.

4. Breaks and Conduct

4.1 Smoking or vaping breaks are only permitted during authorised break times and must be taken in designated areas.
4.2 Time taken for these breaks must not exceed standard break entitlements.
4.3 Employees should be considerate of others when smoking or vaping outside the premises.

5. Non-Compliance

5.1 Failure to comply with this policy may result in disciplinary action under the Company’s procedures.
5.2 Individuals who breach smoke-free legislation may also be liable for fixed penalty fines or criminal prosecution.
5.3 If the Company receives a penalty due to an individual’s actions, it reserves the right to recover the cost from the person responsible.
5.4 Managers should address breaches promptly and fairly, starting with a private discussion, followed by formal action if necessary.

6. Definitions

6.1 For the avoidance of doubt, “smoking” includes the use of:

  • Cigarettes
  • Cigars
  • Pipes
  • E-cigarettes (vapes) and related vaping products

7. Monitoring and Review

7.1 Compliance with this policy will be monitored through routine inspections, feedback, and incident reporting.
7.2 This policy will be reviewed annually, or sooner if required by legislation or operational changes.
